Ölüm cezasının, yaşama hakkının insan onuru çekirdeğini zedelediği açıktır. Çünkü ölüm cezasının yerine getiriliş çeşitlerinin hepsi insan onurunu zedelemektedir. Devletler hukuku tarafından korunan yaşama hakkı ve vahşi ve insanlık dışı ceza yasağı, ölüm cezasının kaldırılması konusunda kesin bir garanti içermemektedir. Ölüm cezasının ayıplanması konusunda genel bir teamül bulunmamakla birlikte, ulusal hukuklarda bu yönde bir gelişim izlenmektedir. Ölüm cezasının yasaklanması bugün Avrupa kamu düzeninin temel bir ögesini oluşturmaktadır Avrupa Birliği bu yasağı bir değer kriter mertebesine yükseltmiş ve Birliğe kabul için bir koşul haline getirmiştir. Dünya genelinde uluslararası hukuk tarafından da hiç de uzak olmayan bir gelecekte ölüm cezasının ayıplanacağını söylemek mümkündür.
It is clear that the death penalty, the right to life, is the core of human dignity. For the death punishment of all kinds of fulfillment is the honour of man. The right to life protected by the law of the States and the ban on wild and unhuman punishments do not contain a certain guarantee of the abolition of the death penalty. Although there is no general teamul on the decrease of death penalty, national law has seen a progress in this direction. The ban on the death penalty today constitutes a fundamental element of the European public order The European Union has raised this ban to a criterion of value and made it a condition for acceptance in the Union. It is possible to say that the death penalty will be extinguished by international law throughout the world in a far-reaching future.
