ADLİ GÖRÜŞME ODALARINDA SUÇ MAĞDURLARIYLA GÖRÜŞME YAPAN ADLİ GÖRÜŞMECİLERİN DENEYİMLERİNİN İNCELENMESİ: ESKİŞEHİR ADLİYESİ

Abstract:

görüşme odalarında, suç mağdurlarının ifade alma süreçlerine katılan adli görüşmecilerin uygulamaya ilişkin algı ve deneyimlerinin ortaya çıkarılmasıdır. Adli görüşmecilerin ifade alım süreçlerindeki deneyimlerini ve uygulamaya ilişkin algılarını belirlemede, nitel araştırma yöntemi kullanılmıştır. Araştırma 2018 Şubat ayında Eskişehir Adliyesinde, adli görüşme odalarında görüşme yapan 26-42 yaş arasındaki 12 adli görüşmeci ile yürütülmüştür. 7 sosyal çalışmacı, 3 pedagog ve 2 psikologla yarı yapılandırılmış görüşme formu esas alınarak derinlemesine görüşmeler yapılmıştır. Verilerin değerlendirilmesinde fenomenolojik analiz yöntemi kullanılmıştır. Araştırma sonucunda, suç mağdurlarının ifadelerinin duruşma salonları yerine AGO’larda alınmasıyla, mağdurların sanıkları hiçbir zaman görmediği ve hâkim/savcıların sorularına doğrudan maruz kalmadığı için örselenmelerinin azaldığı görülmüştür. Ancak AGO sürecinde uygulayıcılar arasındaki işbirliği ve eşgüdüm eksikliği ile ortak dil ve anlayış farkı, belirleyici güç olan hâkim/savcıların kırılgan grup konusundaki eğitim eksiklikleri, mağdurun AGO’da ifade alınmasına sadece hâkim/savcının karar vermesi, teknik aksaklıklar, bekleme süresinin fazlalığı yaşanan sorunlardandır. Adli görüşmecilere hazırlık yapabilecekleri ve görüşme sırasında müdahale teknikleri uygulayabilecekleri gerekli koşulların sağlanması, mağdurun kırılganlık tespitinde ve mağdurla görüşme sürecinde adli görüşmeciye daha fazla söz, yetki ve sorumluluk tanınması, teknik aksaklıkların giderilmesi ve fiziksel koşulların iyileştirilmesi uygulamanın işlevselliğini arttıracağı öngörülmüştür.

Abstract:

This study aims to reveal the perceptions and experiences of forensic interviewers on taking statements of crime victims in Forensic Interview Rooms (AGO), which were introduced on April 3, 2017, in 30 courthouses in Turkey. The qualitative research method was used to determine the perceptions and experiences of forensic interviewers about statement taking processes. The research was carried out in February 2018 in Ecuador Courthouse with 12 forensic interviewers between the ages of 26-46. In-depth interviews were made with a semi-structured interview form created by 7 social workers, 3 pedagogues and 2 psychologists. The phenomenological analysis method was used to evaluate the data. The research result was that the risk of trauma in crime victims whose statements were taken in AGOs instead of hearing rooms was decreased as they didn’t have to see the defendants and were not directly exposed to the questions of judges/procurators. However, lack of cooperation and coordination between interviewers, differences in the common language and understanding, lack of education of judges/processors, who were the determinants, on the vulnerable group, the power to decide whether the victim’s statement should be taken in AGOs belonging solely to judges/processors, technical difficulties and long waiting hours are among the problems faced in AGO practices. It is expected that providing forensic interviewers with the necessary conditions to prepare for their interviews and to apply intervention methods during the interview, granting more right to speak, power and responsibility to the forensic interviewers during the interview and when determining the victim’s vulnerability, removing technical difficulties and improving physical conditions will increase the functionality of the practice.
