İktidarın sınırlanması bağlamında yürütülen modern devlet tartışmaları anayasa konusunu temel bir sorgulama olarak görmektedirler. Tarihsel olarak bakıldığında anayasanın neliği üzerine süregiden felsefi tartışmalar ağırlıklı olarak hukuki sorgulamalarla aynı zemini paylaşmaktadır. Tartışmalar genellikle kendisine nesne olarak bir “anayasal devlet” veya bir “anayasalı devlet” fikrini almaktadırlar. Felsefi bağlamda öne çıkan bir diğer yaklaşım ise devlet ve anayasanın aslen özdeş olduğu fikrine dayanan yaklaşımdır. Hegel’in kendi çağında Almanya’da süregiden anayasa tartışmaları ışığında söz konusu özdeşlik düşüncesine sahip olduğu söylenebilir. Her ne kadar Hegel’in anayasa düşüncesi asli olarak “Hukuk Felsefesi’nin Prensipleri” başlıklı çalışmasında tartışılıyor ve olsa da filozofun erken dönem metinlerinden başlayarak anayasa üzerine düşüncelerini takip etmek mümkündür. Bu çalışmada öncelikli olarak Hegel’in anayasa fikri üzerine yürüttüğü tartışmalar tarihsel bir bağlamda ele alınacak ve Hegel’in yürüttüğü anayasa tartışmasının temel anlamı üzerine bir inceleme sunulacaktır. Bu tarihsel okuma denemesi ayrıca modern devlet tartışması bağlamında belirli bir tavrı da gözler önüne sermektedir.
Contemporary government discussions in the context of the limitation of power see the issue of the constitution as a fundamental question. Historically, long-term philosophical discussions on the nature of the constitution share the same ground with mainly legal questions. Disputes often take the idea of a "constitutional state" or a "constitutional state" as an object. Another approach that stands out in the philosophical context is the approach that is based on the idea that the state and the constitution are actually identical. It can be said that Hegel had the idea of identity in the light of the constitutional debates in Germany during his own time. Although Hegel's constitutional idea is originally discussed in his work entitled "The Principles of Law Philosophy", it is possible for the philosopher to follow his thoughts on the constitution, starting from the early texts. In this study, Hegel’s discussions on the idea of the constitution will primarily be discussed in a historic context and a review of the fundamental meaning of Hegel’s discussion of the constitution will be presented. This historical reading attempt also shows a certain attitude in the context of modern state debate.
