Abstract:

Today, pollution is one of the most important problems. In order to overcome pollution, governments and institutions have been introduced legal measurements both at international and national levels. Protection of marine environment takes place in the scope of these legal measurements. In addition to regulations whose sole purpose is to minimize marine pollution, it is seen that other maritime regulations, like salvage regime, often focus on pollution. Protection of the marine environment was not covered by the salvage legislation until the 1980s. The introduction of incentive rules for salvors, who are at the forefront of combating pollution caused by marine accidents, started with the LOF 80 salvage contract. In addition to LOF 80, environmental awareness in the salvage regime was improved by the 1989 International Convention on Salvage and LOF 2000 Scopic Clause. In this study, environmental awareness in the 1989 International Convention on Salvage, the LOF salvage contracts dated 1980 and 2000 are discussed and solutions are proposed to eliminate the weakness of salvage regime.
