05.12.1951 yılında yürürlüğe giren 5846 sayılı Fikir ve Sanat Eserleri Kanunu kapsamında eser sahiplerine, bu kanunda meydana getirdikleri eserlerinin korunması için geniş haklar tanınmıştır. İlerleyen yıllarda gelişen teknoloji ve değişen dünya görüşü çerçevesinde, kanunda çeşitli değişiklikler ve eklemeler yapılmış, bazı maddeler iptal edilmiştir. Yasada düzenlenen eser sahipliği konusunda günümüze kadar çok sayıda çalışma yapılmış olup, bu çalışmamız ile kanunun 9. ve 10. maddesinde düzenlenen birlikte eser sahipliği türleri ele alınmıştır. Çalışmada, birlikte eser sahipliği türlerinin tanımı yapılmış, özellikleri ayrı ayrı incelenmiş, türlerin birbirleri ile olan benzerlikleri ve farlılıkları anlamaya elverişli şekilde maddeler halinde izah edilmiştir.
Comprehensive rights have been bestowed on the authors as per the Law on Intellectual and Artistic Works numbered 5846 enforced on 05.12.1951 for protection of the works they have produced in compliance with this law. In the years, various amendments and additions have been made to the law in line with the developing technology and changing worldview, some articles have been abrogated. Many studies have been performed about the authorship regulated under the law up to present and the subject has been dealt with in this study as the types of collaborative authorship regulated under the articles 9 and 10 of the law. In the study, conducted with the definitions of the type of collaborative authorship, properties were studied separately, with each type of understanding the similarities and differences in the form of the substance.
