Bilinç kavramının İslam hukukundaki yeri, önemi, haklara ve sorumluluklara etkisinin ortaya konması, araştırmanın amacı olarak ifade edilmektedir (s. 9). Bu genel amacın açılımı olarak; bilinç ile ilgili bilimsel boşluğun doldurulması, bilincin İslam hukuku açısından bir bütün olarak ele alınması, bilinç kavramı ile ilgili kavram kargaşasının sona erdirilmesi ve İslam hukukuna bilinç kavramı çerçevesinde açılım kazandırılmasına yönelik hedefler ortaya konmaktadır (s. 26). Yazar, bilinç konusunu derinlemesine inceleyen bir çalışma yapılmadığını, bunun önemli bir boşluk olduğunu ifade etmektedir. Yazar, İslam hukukunda temyiz gücü çerçevesinde, önemli bir kavram olan bilinç ve bilinç durumlarının incelenmesinin zorunluluk olduğunu söylemektedir. Araştırmacı ayrıca İslam hukukuna bilinç kavramı çerçevesinde açılım kazandırmayı amaçladığını, bunun “Psikolojik veriler ışığında fıkhın yeniden ve bir bütün olarak araştırılması” şeklinde tanımladığı “Fıkıh Psikolojisi” adında yeni bir bilimle, teknik bir çalışmayla yapılabileceğini önermektedir.
