İnsanlık kavramı insancıl bir yaklaşımı benimseyen uzay alanındaki antlaş-maların genel ruhuna katkı sağlayan önemli unsurlardan birisidir. Uzay Ant-laşması’nın birinci maddesinde uzayın keşfi ve kullanılması bütün insanlığa tahsis edilmiştir. Aynı antlaşmanın beşinci maddesinde astronotlar insanlığın uzaydaki temsilcileri olarak addedilmiştir. Son olarak, Ay Antlaşması’nın on birinci maddesi hükmünce Ay ve doğal kaynakları insanlığın ortak mirası olarak kabul edilmiştir. Bu çalışma kapsamında uzay hukukunun kuruluş felsefesinin önemli parçası olan insanlık kavramı ele alınacak ve insanlığın uzay hukuku bağlamında bir uluslararası hukuk kişisi olup olmadığı sorusu-na cevap aranacaktır.
the concept of humanity is one of the important elements that contribute to the general spirit of the antifications in the field of space, the discovery and use of space in the first article of space antification is allocated to all humanity, astronauts were added as representatives of humanity in the space, finally the tenth of first substances of the month antification were considered as the common heritage of humanity and natural resources, under this study, the concept of humanity, which is the important part of the philosophy of the organization of space law, will be addressed and respond to whether there is an international question in the context of space law
The concept of humanity is one of the important elements that con-tribute to the general spirit of the space treaties based on humanitarian grounds. According to the first article of the Outer Space Treaty, the exploration and use of space shall be the province of all mankind. In the fifth article of the same treaty, astronauts are considered as envoys of mankind in outer space. Finally, the Moon and its natu-ral resources have been accepted as the common heritage of mankind according to the eleventh article of the Moon Agreement. In this study, the concept of huma-nity, which is an important part of the founding philosophy of space law, will be discussed and an answer sought as to whether hu-manity has an international legal personality in the context of space law.
