Bilindiği gibi ilk asırlardan itibaren nasların doğru anlaşılması için müçtehidler yoğun bir içtihad faaliyeti içerisine girmişlerdir. Bu kapsamda şer‘i hukukun ikinci kaynağı olan sünnet nasları da tek tek ele alınıp tartışılmıştır. Ancak hadis çoğunlukla ahâd yolla geldiği için bu durum müçtehidlerin hadisleri kabul etmede farklı kriterleri benimsemeleri sonucunu doğurmuştur. Şöyle ki Hz. Peygamber’e isnad edilen bir rivayetin kabulü için senedin sahih olmasını yeterli görenler olduğu gibi senedin sahihliğini yeterli görmeyip, hadis metninin Kur’an’a, meşhur sünnete ve kabul görmüş fıkhî kurallara aykırı olmaması gerektiğini savunanlar da olmuştur. Bu açıdan senedi sahih olduğu halde bazılarınca problemli görülen bir kısım hadisler bu iki kesim arasında ihtilaf konusu olmuştur. Bu hadislerden birisi de “musarrât” hadisidir. Musarrât, satıcının müşteriyi kandırmak için sütü fazla gözüksün diye sağmayıp beklettiği hayvandır. Hadislere göre, böyle bir hayvanı satın alan kimse iki şey arasında muhayyerdir. Bu kimse hayvanı satın aldıktan sonra sütünü sağıp aldatıldığının farkına vardığında isterse hayvanı bir ölçek hurmayla birlikte iade eder ya da hayvanı geri vermeyip elinde tutabilir. Hanefiler bu hadisleri fıkhî kurallara aykırı görmüş ve amel etmemişlerdir. Cumhur ise hadisin sahih olduğunu ve terk edilemeyeceğini savunmuştur. Bu çalışmada bir hukuki ictihad perspektifi sunması açısından her iki tarafın görüşleri, delil ve gerekçeleri detaylı bir şekilde sunulmaya çalışılmıştır.
