Osmanlı Devleti gücünün zirvesinde olduğu dönemde bazı devletlere kapitülasyon vermiştir. Başlangıçta tek taraflı ve geçici süreyle sınırlı sayıda devlete verilen kapitülasyonlar, devletin gücünün zayıflaması, ekonomik kayıpların artmasıyla birlikte çok sayıda devlete verilmiştir. Bu nedenle özellikle Sanayi Devrimi’nden sonra Batılı devletler için Osmanlı toprakları kârlı bir pazar hâline dönüşmüştür. Batılı devletler ülkenin her yanında konsolosluklar açmış, bu konsolosluklarda sonraları kendi vatandaşları hükmüne koyacakları Osmanlı vatandaşı gayrimüslimleri istihdam etmiştir. Bu durum birçok sorunu beraberinde getirmiştir. Bunlardan biri de yabancıların ve onların hizmetine giren gayrimüslimlerin konsolosluk mahkemelerine müracaat etmeleridir. Batılı devletler kendi vatandaşlarının ve onlarla işbirliği eden Osmanlı vatandaşı gayrimüslimlerin hakları için kapitülasyonları âdeta bir kalkan olarak kullanmıştır. Osmanlı vatandaşlarının kapitülasyon verilen ülkelere göç etmeye başlamasıyla meselenin farklı bir boyutu ortaya çıkmıştır. Bu çalışmada Lübnan’da yaşarken Amerika’ya göç edip orada vefat eden Doktor Selim’in tereke meselesi üzerinden kapitülasyon verilen ülkelerden biri olan Amerika Birleşik Devletleri’nin Osmanlı vatandaşı birinin tereke meselesine yaklaşımı analiz edilecektir.
The Ottoman state, at the summit of its power, gave capitulation to some states. Initially, a limited number of unilateral and temporary capitulations were granted to the state, with the weakening of the power of the state, with the increase in economic losses, a large number of states were granted. This is why, especially after the Industrial Revolution, the Ottoman lands have become a profitable market for the Western states. The Western states opened consulties across the country, employing the Ottoman citizens who would then put their citizens under rule in these consulties. This has brought many problems with it. One of these is that foreigners and non-Muslims entering their service appeal to the consulate courts. The Western states have used their capitulations for the rights of their citizens and the Ottoman citizens who cooperate with them as an adjacent hole. As the Ottoman citizens began to immigrate to the rejected countries, a different dimension of the issue emerged. This study will analyze the approach to the issue of a Ottoman citizen of the United States, one of the countries that has been surrendered through the issue of Dr. Selim who migrated to the United States while living in Lebanon and died there.
