On 24 June 2016, the Council of the European Union adopted two new Regulations about property law for couples who enter into a marriage or registered partnership of a cross-border nature. These Regulations are No: 2016/1103 Implementing Enhanced Cooperation in the Area of jurisdiction, Applicable Law and the Recognition and Enforcement of Decisions in Matters of Matrimonial Property Regimes and No: 2016/1104 Implementing Enhanced Cooperation in the Area of Jurisdiction, Applicable Law and the Recognition and Enforcement of Decisions in Matters of Property Consequences of Registered Partnerships. These Regulations deal with applicable law and jurisdiction for decisions in the area of the property regimes of international couples, covering both marriages and registered partnerships; which facilitate the recognition and enforcement of decisions regarding these matters. When compared with marriage, the registered partnership is not adopted in many countries legal system and it is basically unknown; because of that, in this paper, we will examine the provisions of Regulation 2016/1104. In this context, we will first mention the short history of the Council of Europe's work on nonmarital relations and registered partnership which began in the 1980s and continued till today; then the scope of the Regulation, the applicable law of disputes concerning the property of couples who have registered under the Regulations provisions, jurisdiction and recognition and enforcement of the decisions of these matters.
