Türkiye Avrupa Birliği üyeliği için müzakere sürecindedir. Avrupa Birliği dünya tohumculuk sektörünün güçlü bir paydaşı ve referans noktasıdır. Türk çeşit tescil sisteminin AB ile uyumlu olması Türk tohumculuk sektörü açısından önemli bir nirengi noktası olacaktır. Bu çalışmada Avrupa Birliğinin tarla bitkisi türlerinde çeşit tescil uygulamalarını düzenleyen tarla bitkisi türleri çeşitlerinin ortak kataloğuna dair 13 Haziran 2002 tarihli 2002/53/EC sayılı Konsey Direktifi ile ülkemiz Bitki Çeşitlerinin Kayıt Altına Alınması Yönetmeliği ve ilgili bazı mevzuatlar karşılaştırılmıştır. Bu karşılaştırmalar bir uyum tablosu içerisinde toplanarak, başlıklara göre farklılıklar ve uyumluluklar açıklanmıştır. Ülkemiz çeşit tescil mevzuatının büyük bir oranda AB mevzuatı ile uyumlu olduğu görülmüştür. Ülkemiz çeşit muhafaza sisteminin güçlendirilerek 2005/834/EC sayılı Avrupa Konseyi kararına ilave yapılarak ülkemiz çeşit muhafaza uygulamalarının AB ile eşdeğerliğinin onaylanmasının sağlanmasının, ülkemiz ıslahçılarına dezavantaj sağlayan üretim izni uygulamasının revize edilmesi önemli görülmektedir. Makalede Türkiye’deki üretim izni uygulamasının Türk ıslahçılarına dezavantaj yaratan mevcut halini daha eşit ve adil bir biçime dönüştürecek önerilerde bulunulmuştur.
Turkey is in the process of negotiations for EU membership. The European Union is a strong shareholder and reference point of the world’s seed industry. The compatibility of the Turkish registration system with the EU will be an important point in terms of the Turkish seed industry. This study compared the Council Directive 2002/53/EC of 13 June 2002 on the Common Catalog of Species of Species of Species of Species of Species of Species of Species of Species of Species of Species of Species of Species of Species of Species of Species of Species of Species of Species of Species of Species of Species of Species of Species of Species of Species of Species of Species of Species of Species of Species. These comparisons are gathered in a harmonious table, depicting differences and conformities according to the titles. Our country’s registration legislation has been seen to be largely consistent with the EU legislation. In addition to the Council Decision 2005/834/EC of the European Council, it is important to ensure that our country’s various conservation practices are approved by the EU, and to revise the application of the production permit that disadvantages our country’s farmers. The article suggests that the application of the production permit in Turkey will make the current state of disadvantage to the Turkish farmers more equal and fair.
