Modern insan hakları doktrininin temelinde hukuk devleti anlayışı yer almaktadır. Hukuk devletinin en önemli unsurlarından biri de, kuvvetler ayrılığının bir uzantısı olarak, bağımsız ve tarafsız yargıdır. Kuvvetler ayrılığı ilkesinin dönüşüme uğramasıyla birlikte yasama ile yürütme erkleri arasındaki ayrım belirsiz bir hale gelmiştir. Yasama erkinin, seçim sistemlerinin de etkisiyle, yürütme erki içinde erimesi yargı erkinin iktidarın sınırlandırılmasındaki rolünü ve önemini arttırmıştır. Bu durum aynı zamanda yargının bağımsızlığı ve tarafsızlığı üzerindeki siyasal baskıyı da arttırmaktadır. Bu baskının çeşitli boyutları olmakla beraber yasama organındaki hâkimiyeti ve yargı organları üzerindeki yetkileri düşünüldüğünde en büyük baskı yürütme erkinden gelmektedir. Yargı erki üzerindeki bu baskılar meşruiyetini siyasi iktidarı insan hakları lehine sınırlandırmaktan alan hukuk devleti anlayışını tehdit etmektedir. Yargının siyasallaşmasının tek nedeni yargı erki üzerinde yürütme erkinin sahip olduğu yetkiler değildir elbette. Siyasallaşma kimi zaman da doğrudan yargı erkinin kendisinden kaynaklanmaktadır. Bu nedenle yargının siyasallaşmasının çok boyutlu bir olgu olduğunu söylemek gerekir. Bu çalışmanın amacı yargının siyasallaşmasıyla ilgili kavramsal bir çerçeve sunmaktır. Bu kapsamda yargının siyasallaşması olgusu “siyasal kültür”, “yargının bağımsızlığı ve tarafsızlığı” ve “yargısal aktivizm” başlıkları altında incelenecektir.
Modern human rights doctrine based on concept of the rule of law . One of the most important elements of the rule of law is independence and impartiality of the judiciary as an extention of the seperation of powers. With the transformation of the principle of seperation of powers, the distinction between the legislature and executive is became unclear. The dissolition of legislature within the executive with the effect of electoral systems, has increased the role and importance of the judiciary on limitation on power. This situation has also increased the political pressure on the independence and impartiality of the judiciary. Though there are various dimensions of this pressure, in terms of dominance in the legislature and its power over the judiciary, the greatest pressure comes from the executive. These pressures on the judiciary threaten the rule of law, which derives its legitimacy from limiting political power in favor of human rights. Of course, the only reason for the politicization of the judiciary is not the powers of the executive over the judiciary. Politicalization sometimes arises directy from the judiciary itself Therefore, it should be said that the politicization of the judiciary is a multidimensional phenomenon. The purpose of this study is to present a conceptual framework for the politicization of the judiciary. In this context the phenomenon of politicization of the judiciary will be examined under the headings of “political culture”, “indipendence amd impartiality of the judiciary” and “judicial activism”.
