Antik Yunan dönemine kadar uzanan bir tarihe sahip olan sosyal politikalar özellikle sanayi devrimi sonrasında bir iktidar alanı olarak merkezi güç haline gelmiştir. Sosyal politikaların görünürlüğünün arttığı bu dönem temelde işçilerin koşullarının iyileştirilmesi ve düzenlenmesi üzerinden ilerlemiş olsa da, zaman içerisinde kapsamı ve uygulama alanı genişlemiştir. Kadın, yaşlı, çocuk, engelli gibi daha dezavantajlı grupları kapsayacak şekilde genişleyen bu politikalar, iktidarın bahsedilen grupları nasıl konumlandırdığını, yönlendirdiğini, sınırladığını, gözetlediğini ya da denetlediğini göstermektedir. Öte yandan, bir iktidar alanı olan sosyal politikalar her ne kadar eşitlik iddiasını temele alarak düzenlemeler üretse de, iktidarın eril ideolojik temelleri bu sosyal politikaların eşitlik, cinsiyet eşitliği ve eşit haklar iddialarını temelden sorgulanır hale getirmektedir. Bu çalışma, literatür taramasından hareketle ve İş Kanunu (4857 Sayılı) ile Devlet Memurları Kanunu (657 sayılı) üzerinden, Türkiye’de sosyal politikalarda kadının konumlandırılışını feminist bir bakma biçimi ile “öznelik” üzerinden tartışmaya açmayı hedeflemektedir. Foucault’cu perspektiften hareket ederek, “iktidarı” ele alan bu çalışma, iktidarın nüfuz ettiği ‘sosyal politika’ alanını inceleyerek kadının öznelik imkanının sosyal politikalar üzerinden sorgulamasını yapmaktadır. Bu çerçevede sosyal politika alanlarından biri olarak çalışma yaşamının düzenlenmesinde büyük rol oynayan iki kanun incelenerek bu politikalarda kadın özneliğinin imkanı sorgulanmaktadır. İlk olarak iktidarın ne olduğu ve nelere nüfuz ettiği üzerinden bir iktidar alanı olan sosyal politikalar alanı feminist bir bakma biçimi ile ele alınmaktadır. İkinci olarak, çalışma yaşamının işleyişini büyük bir ölçüde oluşturan iki kanun bağlamında kadının çalışma yaşamına dair düzenlemeler, ‘annelik’, ‘ev kadınlığı’ ve ‘çalışan kadın’ temaları üzerinden değerlendirilmektedir
Social policies, which have a history of ancient Greek times, have become central power, especially after the industrial revolution, as a power area. Although this period of increased visibility of social policies has progressed primarily through improving and regulating the working conditions, it has expanded its scope and scope over time. These policies, which extend to cover more disadvantaged groups, such as women, elderly, children, and disabled, show how the authorities position, direct, limit, monitor or control those groups. On the other hand, although social policies, which are a field of power, produce arrangements based on the claim of equality, the wicked ideological foundations of power make the claims of equality, gender equality and equal rights of these social policies fundamentally questioned. This study aims to move from the literary scan and through the Law of Labor (4857) and the Law of State Officers (657) to open to the discussion of the positioning of the woman in social policies in Turkey with a feminist look at the "specificity" through the "specificity". Moving from Foucault's perspective, this study, which deals with "power", examines the field of "social policy" in which the power penetrates, makes the question of the possibility of subjectivity of the woman through social policies. In this context, the two laws that play a major role in the organization of work life as one of the fields of social policy are examined and questioned the possibility of female subjectivity in these policies. First of all, the field of social policies, which is a field of power over what the power is and what it penetrates, is addressed with a feminist look. Secondly, in the context of two laws which largely constitute the functioning of the work life, the rules on the work life of the woman are assessed through the themes 'motherhood', 'home femininity' and 'working woman'
Social policies, which have a history dating back to the Ancient Greek period, have become a central power as a power domain especially after the industrial revolution. Although this period has progressed mainly through the improvement and regulation of the conditions of the workers while the visibility of social policies are increasing, its scope and application area has expanded over time. These policies which expanding to include more disadvantaged groups such as women, elderly people, children and disabled, have shown how the government positions, directs, restricts, monitors or supervises these groups. On the other hand, although social policies, which are a power domain, have produced regulations based on the claim of equality, the masculine ideological foundations of power have maden the claims of these social policies of equality, gender equality and equal rights questionable from the ground up. This study aims to bring the position of women in social policies in Turkey up for discussion starting from the literature review and the Civil Servants Law No. 657 out of 4857 Labour Law with feminist ways of looking "subjectivity". This study, which deals with "power" from a Foucauldian perspective, will examine the field of "social policy" in which the power permeates, and will question the possibility of the subject of women through social policies. In this framework, two laws, which are the current legal regulations on working life, will be examined as one of the areas of social policy, and the possibility of women's subjectivity in these policies will be questioned. First of all, the field of social politics, which is a power domain over what power is and what it permeates, is addressed with a feminist perspective. Secondly, in the context of those two laws that constitute the functioning of working life to a great extent, the regulations regarding the working life of women have been evaluated on the themes of "motherhood", "housewife" and "working woman".
