Analysis of Pakistan Election Laws: Rigging a Dilemma in Pakistan Democratic System

Since independence, the Pakistan election system has been widely recognised for electoral fraud. These elections were alleged for the electoral malpractices that were occurred due to the failure of the Election Commission of Pakistan (ECP). By determining different literature and its analysis one could found that there is a wide gap in this area. Prior researches have determined those factor which influences election transparency. Hence, the current study was attempted to highlight the shortcomings, flaws and factors that works as an impediment in strengthening the stability of democratic politics and also creats distrust among people regarding the process of election. The study aimed to bridge the gap between the modern designed strategy and the future vote-rigging practices in Pakistan. For this purpose, the study has evaluated the shortcomings in Election laws that were manipulated by political parties for their personal interest. Different stages of the election process and the reforms were determined in this study to address the rigging dilemma. The study utilised a mixed-method design wherein the primary data were collected from different political parties, general public and the individuals linked with the electoral process. The secondary data was collected through different government websites and research articles. The Election Act 2017 was critically analysed for which interpretivism philosophy was adopted. The study findings display that there is a great association between poll day, pre-poll and post-poll rigging. The results further display that there exist enormous discrepancies that are manipulated by non-state and state agents.
