Tanzimat dönemi, Osmanlı İmparatorluğu’nun 19. Yüzyılın zorlayıcı koşullarına uyum sağlamak için geçirdiği değişimi ifade eder. Tanzimat döneminin en önemli yönü ise, Osmanlı’nın hukuk alanında gerçekleştirdiği değişimdir. Bu değişim, Batı hukuku yönünde olmuş böylelikle Cumhuriyet dönemi hukuk anlayışından günümüze uzanan hukuk siteminin temelleri bu dönemde atılmıştır. Önce anayasal belgeler olan Tanzimat ve Islahat Fermanları ile temel ilkeler kabul edilmiş, ardından bu ilkeler gözetilerek Batı hukukuna ait kanunlar Osmanlı hukuk düzenine adeta kül halinde alınmıştır. Bu değişim sürecinde, hukukta Batılılaşma sağlanırken hala eskiyi koruma anlayışı nedeniyle ikili (düalist) yapıda bir hukuk sistemi kurulmuştur. Değişim Osmanlı’nın kendi içinden gelen dinamiklerle değil, buna mecbur olmasına neden olan dış dinamikler ile gerçekleşmiştir. Bu nedenle Osmanlı Devleti’nin hukukta modernleşmesi kendine özgülükten büyük oranda uzak niteliktedir denebilir. Buna karşılık bu dönemde günümüz kamu hukukunun ve özellikle idare hukukunun temelleri atılmıştır.

The most important aspect of the Tanzimat period is the change that Ottoman has made in the field of law. This change has occurred in the direction of Western law; thus the foundations of the legal system that extends from the Republican period to the present time have been thrown in this period. The basic principles were first adopted with the Tanzimat and Islahat Ferman, which were constitutional documents, and then these principles were observed and the laws of the Western law were taken into the Ottoman law order in a very silver form. During this process of change, a legal system in a bilateral (dualist) structure has been established due to the concept of the protection of the old, while the Westernization is provided in law. The change occurred not by the dynamics of the Ottoman that came from itself, but by the external dynamics that made it compulsory.
