Trade unions may take action both in labour-related matters and social activities. One of the activities in labour-related matters is individual activities related to judiciary. The aforementioned activities are regulated in the law of Unions and Collective Labour Contract Code No 6356 in Article 26/2. According to the article, the trade unions can sue and also be engaged in a lawsuit on the rights of the employment agreement, work relationship and social security rights upon writen application representing their members and inheritors. The trade union must have side license and right of litigation to follow the case and the writen application of the member is necessary as well. In our study, the legal character of both the right of litigation of the case and the writen application has been examined in detail. Due to differing opinions existing in doctrine, these opinions have been discussed seperately. Moreover, the provision and results of legal relationship that had been rised as a result of writen application has been presented.In our study both Turkish collective labour law and procedural law have been referenced as sources and examples of courts decisions have been given on the subject as well
