Bu çalışmada, 5224 sayılı Sinema Kanunda yapılan ve 18.01.2019 tarihinde yürürlüğe giren değişiklikler kökenlerini liberal yaklaşımdan alan Toplumsal Sorumluluk Kuramı ve J.S. Mill’in Yararcılık Felsefesi bağlamında ele alınmıştır.
In this study, the Social Responsibility Theory and J.S. that the changes made in the Film Act No. 5224 and entered into force on 18.01.2019 originate from a liberal approach. It was discussed in the context of Mill's Philosophy of Utility. Under the limits of the work, only the provisions relating to the audit have been examined. In this context, it was found that there was no structural change in the audit system established in 2004, but a number of shortcomings and problems were solved. With these changes, it is possible to say that the existing film control system is consistent with the concept of "positive freedom" provided by the Social Responsibility Theory. But the main point in the changes made in the law is that the state has assumed the role of judgment between the different arms of the cinema sector. This is due to the developments in the film industry in recent years. The fact that a cinema hall operator controls a significant part of the halls in Turkey and as a result promotes and campaigns on the cinema tickets without the permission of the producer companies and the long advertisements shown before the film have attracted the reaction of the society, film producing companies and the cinema industry employees. Thus, all the campaigns on the movie tickets without the authorization of the filmmaker company are prohibited, the promotion of tickets is prohibited. It has also been restricted to the long advertisements shown before the film, which is a reactionary topic in the society. Although these issues are issues that the sector needs to solve within itself, the legal arrangements aimed at removing the system’s extremism can be accepted within the limits of the principle of free market and beneficial liberalism. This concept, which can be expressed by the concept of "soft" or "elastic" paternalism, enables the State to make arrangements that remain within "reasonable" limits and are aimed at public interest.
