Abstract:

International organizations having been established to achieve certain purposes in accordance with their constituent instruments and playing a crucial role in the legislation and improvement of the rules of international law may commit wrongful acts while carrying out their activities. In this respect, in what circumstances the organization will be held responsible for the alleged wrongful actions and how the responsibility will be exercised have importance. In this regard, the United Nations International Law Commission prepared draft articles on the responsibility for internationally wrongful acts. This study has examined and criticized these draft articles on the responsibility of the member states of the organization who have not ratified these articles yet. While dealing the problems relating to specifying the content of the responsibility, definition of the circumstances and the operation of the responsibility of the international organizations, this study scrutinizes the developments with regard to this subject. Touching on the responsibility of member States and the conditions, this study examines the resolutions of internal and international courts and evaluates the problems encountered in the exercise of the responsibility of the international organization in the context of these resolutions.
