Ombudsmanlık müessesesi, merkezi idareden bağımsız olan ve kural olarak kanunla düzenlenen, hatta birçok ülkede anayasa ile öngörülen bir müessesedir. Ombudsman kamu kurum ve görevlilerinin faaliyetlerinden hoşnutsuz olan vatandaşların şikâyetleri üzerine, idareyi yapılan yanlış uygulamalardan ötürü uyarır ve hukuka uygun davranmaya çağırır. Ombudsmanlığın üç temel özelliği bulunmaktadır. Bunlar yasallık, bağımsızlık ve denetçilik özelliğidir. Bu çalışmada, müessesenin temel özellikleri bağlamında, Avrupa Birliği Ombudsmanının özel olarak irdelenmesi ve milli ombudsmanlıkla topluluk ombudsmanlığı arasındaki benzerliklerin ve farklılıkların ortaya konulması amaçlanmaktadır. Müessese 1992 yılında Avrupa Birliği mevzuatına girmiştir ve milli ombudsmanlardan farklı olarak AB Ombudsmanı, AB kurum ve kuruluşlarına yönelik şikâyetleri inceleyip karara bağlamaktadır. Müessesenin ihdas edildiği günden bugüne, ilgili mevzuatında değişiklikler yaşanmaktadır. Güncel mevzuatı ışığında, yıllık raporlarının da değerlendirilmesi suretiyle, Avrupa Birliğinde ombudsmanlık uygulamasının gerek başvuru konuları gerekse bunlara karşı olan yaklaşım açısından geldiği son noktanın incelenip ortaya konulması, ombudsmanlık denetiminin her açıdan geliştirilip canlılığını koruması açısından oldukça büyük bir önem arz etmektedir.

In this study, it is aimed to specifically examine the European Union Ombudsman in the context of the basic characteristics of the institution and to reveal the similarities and differences between the national ombudsman and the community ombudsman.
