Abstract:

I believe, at present, we are facing the reality of single-party government as effects of “third wave” of democratization is diminishing. Yes, authoritarian and totalitarian regimes are on the rise with the halt of the democratic expansion. Yet, such regimes can even appear as democratic regimes using fake tools of democracy that usually appear to be democratic, i.e., corruption of the contemporary, pluralistic party system. In our opinion, a distinction should be made between real political parties and fake or so-called parties that lay the foundations of legitimacy for authoritarian and totalitarian regimes. In this context, the present study analyses the relationship with the concept of single-party and tools of a democratic state of law. The objective is to reveal the consequences on the democratic state of law that will be faced by a nation with tendency to single-party governments. The conclusion is that all means of a democratic state of law should be established and contemporary, pluralistic democracy should be reflected to the real-life practice in real terms.
