Bu makalede Asur ve Babil’de yemin uygulamasının sosyal, ekonomik, hukuki ve siyasi hayat içerisindeki yeri ve önemi ele alınmaktadır. Bu amaçla hem resmi nitelikteki kraliyet yazıtları ve hukuki kayıtlar hem de şahıslara ait hukuki ve ekonomik nitelikteki belgeler incelenmiştir. Asur ve Babil’de yemin uygulanması toplum hayatı içerisinde sorunların çözümünde ve gerçeğin ortaya konulmasında önemli bir işlevi yerine getirmiş, ayrıca sözleşme ve anlaşmalarda taahhüt edici bir amaca hizmet etmiştir. İncelediğimiz belgeler, yemin etme eyleminin dinsel bir nitelik taşıdığını ve eylemin tapınakta, mahkemede ve kutsal mekânlarda tanrıların huzurunda gerçekleştirildiğini göstermektedir. Asur ve Babil’de yalan yere yemin edenlerin ve ettikleri yemini tutmayanların ağır cezalarla yüzleşmeleri, yeminin bağlayıcı bir özelliği olduğunu ortaya koymaktadır.
This article discusses the place and importance of sworn in Asur and Babylon in social, economic, legal and political life. For this purpose, both the official royal documents and legal records and the legal and economic documents of the persons have been examined. The sworn in Asur and Babylon has pledged an important role in solving problems and revealing the truth in the community life, and has also served a promising purpose in treaties and agreements. The documents we review show that the action of swearing has a religious character and that the action is carried out in the presence of the gods in the temple, court and holy places. In Asur and Babylon, those who swear to a lie and who do not keep their swear face heavy punishments reveal that the swear is a binding feature.
