Sosyal Güvenlik Kurumunun iş kazası ve meslek hastalığı nedeniyle sigortalıya/hak sahiplerine bağladığı gelir ile anılan kişilere yaptığı ödemeleri işverene rücu hakkı, 5510 sayılı Kanun’un 21 ve 23. maddelerinde düzenlenir. Bu davalara ilişkin bazı sorunların günümüzde halen tartışılması gerekmektedir. Zira, kanunların zaman bakımından uygulanması, rücu hakkının hukuki temeli ve niteliği, iç tavan ve dış tavan uygulaması, kaçınılmazlık ilkesi, müteselsil sorumluluk ve bu konulara ilişkin Yargıtay içtihadı dikkate alındığında, birçok sorunun var olduğu görülmektedir. Bu nedenle çalışmamızda anılan konular ele alınmış ve Yüksek Mahkeme içtihadı ile birlikte değerlendirilmiştir.
