Türkiye’de yaşanan yargı sorunu ve bunun bir parçası olan yargı mensuplarının niteliği sorunu, hukuk eğitimine dair tartışma ve arayışları gündeme getirmektedir. Uzunca bir süreden beri hukuk eğitiminde yaşanan sorunlar, sorunun ilgilileri tarafından dile getirilmesine rağmen, henüz ciddi bir adımın atılmadığı görülmektedir. Türkiye’de hukuk eğitimi alanında yaşanan sorunları ve bunlara yönelik çözüm önerilerini ortaya koymak amacıyla gerçekleştirilen bu çalışmada, Türkiye’nin Avrupa Birliği (AB) üyelik süreci göz önünde bulundurularak, önce hukuk eğitimi alanına ilişkin AB eksenli yaşanan gelişmelere genel olarak değinilecektir. Ardından, AB üyesi Almanya hukuk eğitimi ile AB’den ayrılan ve AngloSakson hukuk sisteminin en önemli uygulayıcısı olan İngiltere hukuk eğitimi incelenecektir. Son olarak, Türkiye’de hukuk eğitimi alanında yaşanan sorunlara değinilecek ve çözüm önerileri sunulacaktır.
The judiciary issue in Turkey and the nature of the judges, which is part of it, issues the debate and the search for legal education. The problems that have been experienced in law education for a long time, although the issue has been expressed by the stakeholders, it seems that a serious step has not yet been taken. In this study, aimed at revealing the problems in the field of legal education in Turkey and the suggestions for solutions to them, taking into account the process of membership of Turkey in the European Union (EU), it will first refer to the developments in the field of legal education in the EU axis in general. Then, the EU member Germany will be examining the UK law training, which is leaving the EU and the most important practitioner of the AngloSakson legal system. Finally, the issues in the field of legal education in Turkey will be addressed and solutions proposals will be presented.
