Bu çalışmada Türkiye’de erken Cumhuriyet döneminin anayasal altyapısını oluşturan 1921 ve 1924 tarihli Teşkilat-ı Esasiye Kanunlarının yapım süreçleri ile Cumhuriyet yönetimini anayasal ilke haline getiren 1923 tarihli anayasa değişikliği sürecinde anayasa yapıcıların Meclis görüşmelerinde görünür hale gelen anayasa ve meşruiyet kavramsallaştırmaları incelenmektedir. Dönemin anayasal gelişmelerine damga vuran siyasi aktörlerin yani meclis üyelerinin anayasa ve anayasal meşruiyet konularına yaklaşımlarını anlamak amacıyla Türkiye Büyük Millet Meclisi tutanaklarına odaklanılmaktadır. Çalışmanın temel amacı, Türkiye’de erken Cumhuriyet dönemindeki anayasal gelişmelerin arka planında yer alan düşünsel boyutun içeriğine yani anayasal gelişmelerin içsel dinamiklerinden olan anayasa yapıcıların düşünce ve fikirlerine ışık tutmak ve kavrayışlarını siyaset bilimi kuramı ışığında anlamlandırmaktır. Bir başka deyişle, çalışma Türkiye’nin erken Cumhuriyet dönemi anayasa tarihine odaklanan çalışmalara farklı bir yönden katkı sunmayı ve Meclis tutanaklarını incelemek suretiyle anayasaların yapımında rol oynayan aktörlerin anayasa mefhumu ve anayasal meşruiyete ilişkin bakış açılarını ortaya koymayı amaçlamaktadır. Çalışmanın sonunda incelenen dönemdeki anayasa yapıcıların bakış açılarının büyük ölçüde yirminci yüzyılın en tartışmalı siyaset ve hukuk kuramcılarından olan Carl Schmitt’in anayasa kuramına dair görüşleri ile örtüşmekte olduğu iddia edilmektedir.
In this study in Turkey the constitutional infrastructure of the early Republic period is studied by the constitutional and legitimate conceptualizations that became visible in the parliamentary talks of the constitutional reforms of 1923 which made the constitutional principle of the Republic's administration and the process of the constitutional reforms of the Republic's constitutional legislation of 1921 and 1924 which formed the constitutional infrastructure of the early Republic period. The Greater National Assembly of Turkey is focused on the attitudes of political actors, namely the members of the parliament, to understand their approach to the issues of constitutional and constitutional legitimacy. The main objective of the study is to keep light on the contents of the intellectual dimension in the background of the constitutional developments in the early Republic of Turkey, i.e. the thoughts and ideas of the constituent creators, which are from the inner dynamics of the constitutional developments, and to understand their concepts in the light of the political science theory. In other words, the study aims to contribute in a different way to the work focused on the constitutional history of the early Republic of Turkey and to reveal the views of the actors who play a role in the constitution and constitutional legitimacy by examining Parliament’s attitudes. The study concludes that the views of the constituent creators in the study period are largely in line with the views of Carl Schmitt, one of the most controversial political and legal theorists of the twentieth century, on the constitutional theory.
