Ceza zamanaşımı engelleri TCK bağlamında Ceza zamanaşımının durması ve ceza zamanaşımının kesilmesi olarak iki şekilde karşımıza çıkmaktadır. TCK’da ceza zamanaşımını durduran sebepler gösterilmemiştir. Buna karşın, ceza zamanaşımını durduran özel yasal düzenlemeler mevcuttur. Milletvekilliği sıfatının kazanılması, hükümlünün asker olması, diğer bir cezanın infaz ediliyor olması, cezanın infazının ertelenmesi veya durdurulması gibi sebepler, ceza zamanaşımını durdurur. Ceza zamanaşımının durma nedeni mevcut oldukça, ceza zamanaşımı işlemeyecektir. Mahkûmiyet hükmünün infazı için hükümlüye yapılan tebligat, TCK düzenlemesine göre; mahkûmiyet hükmünün infazı için hükümlünün yakalanması, hükümlünün zamanaşımı süresi içinde iki yıldan fazla hapis cezasını gerektiren kasıtlı bir suç işlemesi gibi hususlar, ceza zamanaşımını kesen hususlardandır
There are two kinds of penalties that can be interrupted in terms of penalties and penalties in terms of penalties. There is no reason to stop the punishment period in TCK. However, there are special legal regulations that stop the penalty period. Reasons such as winning the status of parliamentary, the convicted being a soldier, the other punishment is being executed, the delay or suspension of the execution of the punishment stops the term of punishment. The removal of the penalty by statute of limitations in the context of the Turkish Penal Code in terms of the suspension or cancellation of the implementation of this clause is reflected in two forms. Where the reasons that suspend the enforcement of the statute of limitations have not been provided in the Turkish Penal Code (Turkish Criminal Code). There are, however, special legal provisions that cancel the issue of removal of the penalty by statute of limitations. The reasons such as winning the deputyship, being convict during military service, being sentenced under an another judgment, the delay or suspension of the execution of the sentence are all reasons for the suspension of the penalty by statute of limitations. Since the reason for the cessation of the criminal time limit is present, the statute of limitations will not be effective. The notification of the convicted person is subject to the provisions of the Turkish Criminal Code; for example, arresting of a convicted person for the execution of a conviction and a deliberate offense for more than two years of imprisonment are factors that nullify the effect of the statute of limitations.
