Eşitlik kavramı sosyal bilimlerin farklı disiplinlerinde ve hukukta sıklıkla kullanılan bir kavram olup hukuk dilinde bireylerin yasalar önünde ayırım yapılmadan muamele görmesi anlamını içermektedir. Bu çalışma eşitlik kavramının hukukta temel ilke olmasında öncü rol oynayan düşünürler John Locke ve Jean Jacques Rousseau’daki eşitlik kavramlarını ele almaktadır. Bu iki düşünür yalnızca felsefe ve sosyal bilim alanlarında değil, evrensel hukuk düşüncesinin de oluşumunda önemli rol oynamışlardır. Bu iki düşünürdeki eşitlik kavramları ayrıca cumhuriyetçi gelenek ile liberal gelenek bakış açılarını da temsil ettiğinden, iki büyük farklı paradigmanın ve bakış açısının eşitlik kavramına olan yaklaşımlarını da kıyaslama imkanı vermektedir. Çalışmanın sonunda ise bu iki düşünür ile temsil ettikleri geleneğin eşitlik kavramına olan bakış açıları ayrışan ve benzeşen noktaları ile irdelenmektedir.

The concept of equality is mostly well known concept in social sciences and law, whereas it has a meaning of not discriminating any people in front of the laws. This study takes the concept of equality in the philosophical arguments of John Lock and Jean Jacques Rousseau. These two big thinkers played a crucial role in the development of philosophy and social sciences, as well as universal law understanding. Since the concept of the equality in those two thinkers represents the republican and liberal tradition, it gives an opportunity to compare the two big paradigms on the concept of equality. At the end of the study, the views of those two thinkers and paradigms were compared to each other on the basis of similarities and differences.
