Evrensel insan hakları kavramı tarihsel olarak liberal kavramlar ile ilişkilendirilmiş ve yine bu geleneğin temsilcileri tarafından savunula gelmiştir. Evrensel hak düşüncesine yöneltilen önemli eleştirilerden birisi de kültürel çeşitlilik ve farkı vurgulayan cemaatçi kuramcılar tarafından dile getirilmiştir. Liberalizmin 20. Yüzyıldaki en önemli temsilcisi sayılan John Rawls’un kuramının geçirdiği değişimler, hakların evrenselliği tartışması açısından özel bir örnek teşkil etmektedir. Şöyle ki Rawls, ilk eserlerinde savunduğu evrensel erimli adalet kuramından uzaklaşmış, kültüralizmin analitik araçlarını devralmak yoluyla cemaatçi tezlere yaklaşmıştır. Bu makalenin amacı Rawls’un hak kavrayışının evrenselcilik-kültüralizm ekseninde incelemesi ve1970’ler ve 1990’lar arasında izi sürülen bu dönüşümün, hak kavrayışında ortaya çıkardığı sonuçların tartışılmasıdır.

Abstract:

The idea of universal human rights has historically been associated with liberalism, and advocated by its representatives. Challenges to this view from within the Western tradition has been articulated by communitarian thinkers, who in turn base their critique on the ideas of cultural diversity and difference. John Rawls’s theory of justice posits a case worthy of examination with this respect. Rawls is regarded as the foremost representative of liberal thought in the 20th century. Yet, changing moments of his theory between the 1970s and the 1990s demonstrates a tendency towards incorporating culturalist concepts and modes of analysis. This article analyses Rawls’s conception of human rights, in its changing content and significance, throughout this trajectory.
