Orhun Abideleri’ne göre Tanrı bir kişiyi kutlu kılarak saadet ve devlete eriştirmek isterse ona dürüst, bilgili ve cesaretli olma gibi birtakım özellikler bahşederek, bu kişinin bahtını açardı. Ayrıca onun emrine bilgili, cesur ve dürüst devlet adamları verirdi. Bilgili ve dürüst bir tabiata sahip olan kağan, hukuk anlayışını ifade eden töreye yeni kurallar ekleme ve töreyi yeniden düzenleme hakkına sahip idi. Ancak kağan mutlak bir güç sahibi değildi. Hükümdarın aldığı büyük kararlar kurultaylarda karara bağlanmaktaydı. Kurultaylarda alınan kararlar törenin diğer bir kaynağını oluşturmataydı. Toplum yaşamı içerisinde zamanla ortaya çıkan gelenek görenekler ise, törenin bir başka kaynağını oluşturmaktaydı. Ancak bunların töre haline gelebilmesi için, kağanın iradesi şarttı. Dolayısıyla kağanlar yaşam için iyiliği, faydalılığı sınanmış ve uzun bir süre içerisinde birikerek ortaya çıkmış gelenek göreneklere, kendi emirlerini ve kurultaylarda alınan kararları da ekleyerek toplumun hukuk düzenini oluşturmaktaydılar. Kağan; bilgisi ile milletine yol göstermeli, cesareti ile savaşlar kazanarak halkını iktisadi yönden kalkındırmalıydı. Çünkü bozkır coğrafyasında iktisadi gelir kaynakları son derece kısıtlıydı, bu nedenle iktisadi refah büyük ölçüde hükümdarın askeri ve siyasi alanda başarısına bağlıydı. Bu nedenle kağanın kazandıklarını orun adı verilen bir düzene göre milletine dağıtarak, iktisadi yönden adaleti tesis etmesi gerekmekteydi.
