Abstract:

Deniz İş Hukuku yapılan işin niteliği nedeniyle 4857 sayılı İş Kanunu’ndan farklılık göstermektedir. Ayrıca denizcilik teamüllerinin çalışma biçimlerini derinden etkileyişi Deniz İş Hukuku’nda muğlak alanlar yaratmaktadır. Bu durum zaman zaman İş Hukuku’na ilişkin hükümlerin deniz işlerinde kullanılmasına neden olmaktadır. Sorunun temel nedeni; mevzuatın yetersizliği, eskiliği ve denizcilikteki yazılı olmayan kurallardır. Bu çalışma kapsamında Deniz İş Kanunu ile İş Kanunu arasındaki ilişkiden bahsedildikten sonra deniz hizmet sözleşmelerine değinilmiştir. Ardından deniz hizmet sözleşmelerini sona erdiren durumlar açıklığa kavuşturulduktan sonra söz konusu sözleşmelerin feshinin doğurduğu sonuçlara yer verilmiştir.
