Abstract:

“Hak” kavramı bir insanın isteyebileceği, öne sürebileceği ve eylemli olarak kullanabileceği bir durumu anlatır. Sanayileşme neticesinde artan kentleşme olgusu beraberinde kentli haklarını gündeme getirmiş ve en önemli hak grupları arasında ilk sıralara yerleştirmiştir. Bireylerin yaşamının büyük bir oranında yer almasına karşın özellikle Türkiye’de kentli haklarının tam olarak bilindiği söylenemez. Yurttaşların sahip oldukları haklardan gerçekten yararlanabilmesi için bu hakların öznesinin, konusunun, sınırlarının, uyuşmazlıkların nasıl çözüleceğinin, hangi durumlarda yararlanılabileceklerinin ve hangi eylemlerin cezai müeyyide gerektirdiğinin bilinmesi şarttır. Kentli haklarında temel gaye, kentlilere insan onuruna yakışan bir yaşamın sağlanmasıdır. Kentlerde yaşamın artmasıyla önemi daha da artan kentli hakları birçok uluslararası belgelerde yer aldığı gibi Türk hukuk sistemi içerisinde de yer almaktadır. Bu çalışmada bir kentli hakkı olarak “katılım hakkı”, ulusal ve uluslararası mevzuat karşılaştırılarak incelenmiştir. Yerelleşen günümüz dünyasında demokrasi yalnızca ulusal düzeydeki mekanizmalarda değil, yerel düzeydeki mekanizmalarda da sağlanmak istenmektedir. Çalışma hem yerel mevzuatın ne denli uluslararası mevzuat ile uyumlu olduğunu, hem de yerel mevzuatın katılım, yönetişim ve yerel demokrasiyi ne denli gerçekleştirdiğini göstermeyi amaçlamıştır. Yapılan incelemenin sonucunda yerel mevzuatın katılım, yönetişim ve demokrasi bağlamında kent sakinlerine -uluslararası mevzuata uygun- belli başlı haklar verdiği, ancak kent sakinlerinin kentli haklarını bilmedikleri ve yerel düzeyde tam anlamıyla bir katılımın gerçekleşmediği görülmüştür.

The concept of right refers to a situation in which a human being may want, assert, and act. As a result of industrialization, the increasing urbanization phenomenon has brought the city rights to the agenda and placed it among the most important rights groups. Although a large proportion of individuals involved in the city life, especially human rights in Turkey are not exactly known. In order for citizens to benefit from the rights they have, it is necessary to know the subject, subject, limits, disputes, the situations in which they can be used, and what actions require criminal sanctions. The main purpose of city rights is to provide a city with a life worthy of human dignity. City rights, whose importance increases with the increase in life in cities, are included in many international documents as well as in the Turkish legal system. In this study, the right to participate as a city right is examined by comparing national and international legislation. In today’s localized world, democracy is not only aimed at mechanisms at national level, but also at local level mechanisms. The study aims to show whether the local legislation is in line with the international legislation and the extent to which local legislation implements participation, governance and local democracy. As a result of the investigation, it was seen that local legislation gave the citizens of the city in the context of participation, governance and democracy in accordance with the international legislation, but they did not know the city rights of the city residents and no full participation at the local level.
