Türk Sınai Mülkiyet Hukuku Çerçevesinde Marka ile Coğrafi İşaretlerin Karşılaştırılması

Marka ve coğrafi işaretler, sınai mülkiyet kapsamının önemli öğeleri sayılır. Bu işaretler, mal ve hizmet ürünleri bağlamında ayrıt edici tanıtımına ve kalite güvencesine aracılık etmektedir. Bu işaretler kapsadığı ürünlere bağlı olarak tescil ile işaret sahiplerine özel yasal koruma olanakları sağlar. Her iki marka ve coğrfi işaretler kasadığı ürünlerin tanıtıtımına ve güvenine yarayan yönetmlerle yasanın sağladığı hakların kullanımını işlevsel hal getirmekle gerek ülkenin ekonomi ve ticaret ortamının güven ve glişmesini etkilemekle, ürünlere bu işaret araçlarla büyük pazar çevresi oluşturmaktadır. Bu bakımdan her iki işaretin de kapsadığı ürünlere ilişkin genel amacı ve ilişkin olduğu ürünlerin kimliklerini ayrıt edici biçimde tanımlamak bu işaretlerin ortak ve bezer işlevleri olmakla birlikte her birinin bu yönde izlediği ve sağladığı haklar bir bütünlük içinde birbirinden farklı işlev ve yöntemler izlemektedirler. Sınai mülkiyeti simgeleyen marka ve coğrafi arasındaki ilişkinin milli ve yerli boyutları bağlamında mal ve hizmetlerin tanıtımı ve üretim yer ve kültürünün rekabetçi biçimde güven sağlaması yönünde birbirini tamamlayan bir kimlik bütünü olarak ortaya çıktığı görülecektir. Bu açıdan bu iki işaretin benzer ve farklı yönlerinin incelenmesi, aralarındaki ilişkinin anlaşılması ve tükteicilere sağladığı yararlar ile bu mülkiyet işaretlerinin sahiplerine sağlanan hakların belirlenmesi için yararlı olacaktır. Bu çalışmada marka ve coğrafi işaretlerin özellikle Türk Sınai Mülkiyet Kanunu çerçevesinde tescili için gereken koşullar ile bu işaretlerin kapsadığı ürünler ve koruma altına alınan haklar bağlamında arasındaki benzer ve farklı yönler karşılaştırmalı olarak incelenecektir.

Comparison of trademarks and geographical signs within the framework of the Turkish Property Law

Trademarks and geographical indications are considered important items of industrial property. These signs mediate distinctive presentation and quality assurance in the context of goods and services. In addition, these markings provide special legal protection possibilities for signatories, depending on the products they cover. Both brands and geographical indications constitute a major market environment for these products by influencing the confidence and well-being of the economy and the trade environment of the country, with the use of the rights provided by the legislation of the legislature to promote and trust the commodity of the commodity. In this regard, to define the identities of the products which are both general and related to the products covered by both brands, the rights and obligations that each follows and follows different functions and methods in a unit.  As a matter of fact, it will be seen that the relationship between trademarks and geographical indications symbolizing industrial property in the framework of the national economy and cultural composition emerged as a complementary identity to each other in the promotion of goods and services in the context of national and indigenous dimensions and in the competitive form of production and culture. In this regard, the examination of similar and divergent aspects of these two marks will be useful for understanding the relationship between them and for the benefit they provide to the consumers and for determining the rights granted to the owners of these property signs. In this study, the similarities and differences between the trademark and geographical indications, in particular the requirements for registration under the Turkish Industrial Property Law, and the products covered by these marks and the rights under protection, will be examined comparatively.
