Birleşmiş Milletler Şartı ve uluslararası hukukun emredici kuralları gereğince kuvvet kullanma ve kullanma tehdidinde bulunma yasaktır. Ancak bu yasağa rağmen uluslararası hukuka aykırı fiiller ve bunlara karşı zorlama yollarına başvurulduğu da bir gerçektir. Uluslararası hukukta misilleme, müdahale ve zararla karşılık savaşa varmayan zorlama yolları olarak sayılmaktadır. Bu yollardan biri olan zararla karşılık yolu, kapsamındaki fiillerin genel olarak kuvvet kullanma ve kuvvet kullanma tehdidi içerdiğinden dolayı uluslararası hukuka aykırılığı tartışma konusudur. Bu çalışmada zararla karşılık zorlama yolunun kapsamı, başvurma şartları ve sınırları, teori ve uygulama açısından incelenecektir
