Abstract:

1 Ocak 2014 tarihinde İsviçre İcra ve İflas Kanunu’nda özellikle aciz hukukuna ilişkin değişiklikler göze çarpmaktadır. Aciz hukukunda batık şirketlerin yeniden ekonomik hayata kazandırılması için alınacak önlemler, buna karşılık kurtarılması mümkün olmayan şirketlere karşı zararın enaza indirilmesi önem arzetmektedir. Aciz hukukunun bu temel amaçları arasında kurulmak istenen denge, tüm dünyada olduğu gibi İsviçre’de de İsviçre İcra ve İflas Kanunu’nda önemli değişiklikler meydana getirmiştir. Aciz hukukuna ilişkin çözüm arayışları ise kendini konkordato sürecinin tadil edilerek yeniden etkin hale getirilmesi şeklinde kendini göstermiştir.
