Sahâbenin görüş, fetva ve ictihadları kendilerinden sonra gelen nesillere rehberlik etmiş ve bu nesillerde oluşan fıkhî anlayışa kaynaklık etmiştir. Sahâbenin yaklaşımı bu anlamda İslâm fıkhının gelişim seyrini şekillendirmiştir. Bu itibarla onların meselelere bakışı, nasları kullanma yöntemleri ve ictihadlarında dikkate aldıkları hususlar önem arz etmektedir. Sahâbenin bir kısmı fıkıh ve içtihâd bilgisiyle öne çıkmıştır. Onlardan biri de ismi yedi müctehid sahâbî arasında zikredilen ve Hz. Peygamber’in “Allah’ım onu dinde fakih kıl ve ona tevili öğret” duasına mazhar olan Abdullah b. Abbâs’tır (v. 68/687). Görüş ve ictihadları, furû-i fıkıhta olduğu gibi daha sonra gelişen fıkıh usulüne de kaynaklık eden İbn Abbâs, genellikle tefsir konusundaki yetkinliğiyle bilinse de aslında hadis ve fıkıh gibi alanlarda da öne çıkmıştır. Araştırdığımız kadarıyla usulî yönü üzerinde herhangi bir çalışma yapılmamış olan İbn Abbâs’ın nâsih-mensûh, esbâb-ı nüzûl ve nasslara yüklenen anlam konularındaki görüşleri fıkıh usûlü için ayrı bir önemi haizdir. Özellikle hükmü belirleme noktasında aslî delillere vurgusu dikkat çekmektedir. Çalışmamızda İbn Abbâs’ın, ictihadlarında takip ettiği metotlar içerisinden aslî deliller ele alınacaktır.
The opinions, fatwas and jurisprudence of the Companions guided the generations that came after them and became the source of the fiqh understanding formed in these generations. In this sense, the approach of the Companions shaped the course of development of Islamic fiqh. In this respect, their view of the issues, the methods of using the verses and the points they consider in their jurisprudences are important. Some of the Companions came to the fore with their knowledge of fiqh and jurisprudence. One of them is Abdullah Ibn Abbas (d. 68/687), whose name is mentioned among the seven mujtahid companions, and who was the recipient of the Prophet's prayer "My Allah, make him a faqih in religion and teach him interpretation". Ibn Abbas, whose views and jurisprudences were the source of the later fiqh method, as well as in furu-i fiqh, although generally known for his competence in interpretation, actually came to the fore in fields such as hadith and fiqh. As far as we have researched, Ibn Abbas's views on the issues of nasih-mansuh, esbâb-ı nüzûl and meaning attributed to nass have a special importance for the method of fiqh. In particular, the emphasis on fundamental evidence in determining the verdict draws attention. İn our study, we will consider the essential evidences in the method followed by Ibn Abbas in his jurisprudences.
