Abstract:

We live in an age where globalization is dominant, and on the other hand, communication is progressing rapidly. As a result of this fact, individuals and societies get into a transformation cataclysm involuntarily. Human beings, who are a social being, try various ways and methods in order to stay healthy in this change and transformation climate. Sometimes, these methods are realized by the issued legal regulations and sometimes by spirituality. However, the intervention of the sanctity of private life which is the problem of our age cannot be prevented. However, privacy concept in Islamic Law literature has come into prominence always. We see the importance of privacy in both Koran and the Profit’s tradition very clearly. Hence, handling of “private life” concept in the framework of Islamic Law is extremely significant in terms of the validity of the concept. At the same time, the contradictions arising from the multidimensionality of the concept stands out as a subject requiring sensitivity. Therefore, in this article, it is aimed that perspective of Islamic Law towards the private life concept and handling of this concept by modern legal systems is evaluated with its main lines.
