Ülkemizde idarenin denetimini sağlayacak yeterli yol ve yöntemler söz konusudur. Ancak denetimin etkinliği ve denetimin neticelerinin saygıyla karşılandığı ve denetimin gereklerinin hayata aktarıldığını söylemek maalesef mümkün görünmemektedir. Denetimler içindeetkilisi olması gereken yargısal denetim, kendisinden beklenen etkinliği gerçekleştirememiştir. İçerden ve dışarıdan idarenin yeterince denetlenemediği, kontrol altında tutulamadığına yönelik yakınma ve eleştirilere bir nebze çare olmak, olumlu bir yanıt verebilmek için başta yasal bir düzenlemenin konusu edilmiş ve fakat Anayasa Mahkemesinin ilgili yasal düzenlemeyi iptali üzerine Anayasada yapılan bir değişiklikle anayasal bir hüviyete büründürülüp yasal düzenleme konusu edilen Kamu Denetçiliği Kurumu bu çerçevede oluşmuştur.
