Gün geçtikçe artan kamusal ihtiyaçlar ve yeni yeni ortaya çıkan sahalar, yönetim organlarını farklı çarelere doğru sürüklemektedir. Özellikle büyük çaplı kamu hizmetlerinin görülmesinde taşınmaz temini ihtiyacı ortaya çıkmakta ve idareler bu ihtiyacı gidermek maksadıyla yeni bir takım temayüller sergilemektedirler. Bu temayüllerin belki de günümüzdeçok karşımıza çıkanı, kamulaştırmadır. Kamulaştırma ile devlet –yani idare- taşınmaz temininde çok daha hızlı ve etkili bir hareket sahası bulmaktadır. Kamulaştırma ile taşınmaz üzerindeki özel mülkiyet ortadan kaldırıldığından, mülkiyet gibi temel bir hakka bu şekilde kolayca müdahale edilememesini temin için işlem bir takım şartlara bağlanmaktadır. Kamulaştırma işlemi doğrudan mülkiyetle alakalı olmakla beraber, aslında göz ardı edilmemesi gereken bazı diğer haklar da söz konusu olabilmektedir. Bu hakların başında ise sınırlı ayni haklar gelir. Kamulaştırma prosedüründe devlet, tamamıyla karşısına maliki alarak, onun tatminini sağlamak suretiyle ihtiyacı olan taşınmazı elde etmektedir. Ancak şu kadar var ki, diğer şahsi ve bilhassa da –sınırlı da olsa- ayni nitelikteki hak sahiplerini göz ardı etmek çok da hakkaniyet temeline oturmamaktadır. Bu çalışmayla kamulaştırmanın sınırlı ayni haklara etkisinde, günümüz hukuk hayatının yansımalarını ele aldık. Ancak kapsamlı bir düzenlemeyle bu alanda bir takım iyileştirmelerin yapılması gerektiği de dikkatten uzak tutulmamalıdır.
The ever-growing public needs and new emerging spaces drive the management bodies to different ways. Especially when large-scale public services are seen, the need for non-moving supply is emerging, and the administrations are presenting a new set of themes in order to address this need. This can be a great deal of humiliation and humiliation to us today. The publication and the government – i.e. the administration – find a much faster and more effective field of movement in the non-moving provision. Since privatization and non-private property are eliminated, the process is linked to a set of conditions to ensure that a basic right such as property is not easily interfered. While the process of privatization is directly related to property, there may be some other rights that should not be neglected. These rights are limited to the same rights. In the process of communalization, the state gets the immovable that it needs to ensure its satisfaction by taking the property in its entirety. But there is so much that the ignorance of other persons and in particular – even though limited – of the rightholders of the same quality is not much on the basis of justice. With this study, we discussed the reflections of today’s legal life, with the limitation of the rights of privatization. However, with a comprehensive arrangement there should be a number of improvements in this area and should not be kept away from attention.
