Parlamenter sistemlerin ortaya çıkmasıyla birlikte halkın mali alanda söz sahibi olma girişimleri olarak ifade edilen bütçe hakkı, yaklaşık olarak 800 yıl süren demokrasi savaşı neticesinde, yöneticilerin keyfi bir biçimde vergi salmalarına gösterilen halk tepkisi ile elde edilmiştir. Bütçe hakkına dair ilk hareketler İngiltere’de ortaya çıkmış ve sonrasında diğer ülkelere yayılmıştır. İngiltere’de saray ve halk arasındaki ilk kıvılcımın hangi tarihte ateşlendiği tam olarak bilinmemekle birlikte ilk yazılı belgenin Magna Carta olduğu konusunda fikir birliği bulunmaktadır. Ülkemizde ise bütçe hakkının gelişimi cumhuriyet öncesi dönemde batıdakinin aksine halk iradesini kabul ettirme çabaları sonucunda değil yenilikçi devlet adamlarının girişimleri neticesinde yaşanmıştır. Cumhuriyetin ilanından sonra ise gerek çıkarılan anayasalarda gerekse kanunlarda bütçeye ve bütçe hakkına dair kesin ve net hükümlere yer verilmiştir. Bu çalışmada bütçe ve bütçe hakkı kavramlarına yer verildikten sonra ülkemizde bütçe hakkının gelişim süreci hakkında bilgi verilip, çıkarılan anayasalar ve kanunlar çerçevesinde ne gibi düzenlemeler yapıldığı açıklanmaya çalışılacaktır.
The right of budget, expressed as the attempts of the people to be owned in the financial field with the emergence of parliamentary systems, was obtained by the public reaction of the governors to a pleasantly imposing taxes as a result of the almost 800-year democratic war. The first movements on budget rights appeared in the UK and then spread to other countries. In the UK, it is unknown exactly when the first flame between the palace and the people was launched, but the first written document is the Magna Carta. In our country, the development of the budget right in the pre-Republican period was not the result of the efforts to accept the will of the people, but the result of the initiatives of the innovative state men. After the proclamation of the Republic, in the necessary constitutions, if necessary, the laws have placed clear and clear provisions on the budget and the right to budget. In this study, the concepts of budget and budget rights will be included in our country, and we will try to explain what arrangements are made in the framework of the constitutions and laws adopted.
