Kişilerin serbest dolaşımı, Avrupa vatandaşlığına bağlı temel bir hak niteliğindedir. Bilindiği gibi, Avrupa Birliği, 1 Mayıs 2004’te tarihininbüyük genişlemesini gerçekleştirmiştir. Beşinci genişlemeyle birlikte, Birliğe üye eski devletler, işgücü piyasalarını korumak amacıyla yeni üye devlet vatandaşlarının Birlik sınırları içerisinde serbest dolaşım haklarını kullanmaları önünde hukuki dayanağını Katılım Antlaşması’nda bulan birtakım kısıtlamalar getirmişlerdir. Bu çalışmanın konusunu, katılım tarihinden itibaren uygulamaya konulan serbest dolaşım hakkına ilişkin kısıtlamaların kapsamı ve hukuki niteliği ile konunun güncel gelişmeler ışığında Türkiye’nin tam üyeliği açısından incelenmesi oluşturmaktadır.
