Avrupa Topluluğu Andlaşması, bu Andlaşmanın yorumlanması ve uygulanmasında hukuka uygunluğun gözetilmesi görevini Avrupa Toplulukları Adalet Divanına (ATAD) vermiştir. Maastricht, Amsterdam ve Nice Andlaşmaları ile ATAD’ın yargı yetkisinde önemli değişiklikler yapılmıştır. Çalışmada öncelikle Divan’ın yapısı incelenmiş daha sonra Topluluk yargı sisteminde açılabilecek dava türleri incelenmiştir. Tek Avrupa Senediyle kurulan İlk Derece Mahkemesinin sınırlı yargı yetkisi Nice Andlaşmasıyla genişletilmiş; Topluluk yargı organları arasındaki yetki dağılımı yeniden yapılmıştır. Bu değişiklikle, ATAD’ın işyükü azalırken ''daha önemli Topluluk konularında'' yetkili kalmaya devam etmiştir. Nice Andlaşmasıyla yargı sistemine getirilenbüyük yenilik ise yargısal panellerin kurulması ve İlk Derece Mahkemesine önkarar başvurularında yargılama yetkisinin tanınmasıdır.
The Treaty of the European Community has assigned the responsibility of monitoring legal conformity in the interpretation and implementation of this Treaty to the Court of Justice of the European Communities (ATAD). The Maastricht, Amsterdam and Nice Agreements have made significant changes in the jurisdiction of the ATAD. The study first examined the structure of the Divan and then examined the types of cases that could be opened in the Community judicial system. The limited jurisdiction of the First Court, established by the Single European Senate, was extended by the Nice Agreement; the distribution of jurisdiction between the Community judicial bodies was rebuilt. With this change, ATAD’s workload has continued to remain competent in “more important Community matters” while decreasing. The great novelty brought to the judicial system by the Nice Treaty is the establishment of judicial panels and the recognition of the jurisdiction in appeals to the Court of First Instance.
