Abstract:

Devlet klasik kamu hizmetlerini özel hukuk kişilerine gördürme noktasında, bulunulan döneme göre bir tercih yapıp o dönemin durum ve şartlarına göre yeni sözleşme tipleri belirlemektedir. Zamanla gelişen ve değişen sözleşme tiplerinin son formu karşımıza “kamu özel işbirliği” olarak çıkmaktadır. Doktrinde, bu yeni modelin hukuksal çerçevesinin belirlenebilmesi ve söz konusu modelin getirdiği ve götürdüklerinin tayini noktasında geniş tartışmalar yapıldığı görülmektedir. Bu tartışmaları incelemek, irdelemek, çözüm bulabilmek açısından bir katkıda bulunabilmek noktasında bu çalışma kaleme alınmıştır
