Abstract:

The Competition Authority has drawn up a draft guidelines on the assessment of the behavior of the prospects in the case of justice in terms of the abuse of the legal status regulated and prohibited in Article 6 of the Law No. 4054 on the Protection of Competition and opened to the public opinion. The 82nd Rome Treaty was published by the European Commission. The draft, which has large similarities in the structure or in the interior of the Commission's Application Priorities on Exceptional Behavior of the Procedures in the Judicial Situation, is the first secondary regulation that has been prepared in the field of unilateral behavior in the Turkish competition law so far. In this article, the contents of the draft are examined from a critical point of view. In this context, Article 6 is answered in Turkey, the scope of the guide to be prepared if such a need is assessed and how the legal regime should be determined, the guide is discussing the purpose followed or to be followed by Article 6 and the other elements to be added to the guide are addressed.
