Bu çalışmanın konusunu yasal önalım hakkını engelleyen bir durum olarak fiili taksim oluşturmaktadır. Bu kapsamda, çalışmada öncelikle yasal önalım hakkında temel bilgilere yer verilmiştir. Burada yasal önalım hakkı kavramı izah edilmiş, ardından yasal önalım hakkının hukukî niteliği ve kullanılması için gereken şartlar ele alınmıştır. Daha sonra fiili taksim açıklanmış ve şartları incelenmiştir. Akabinde ise, fiili taksimin yasal önalıma etkisi anlatılmış ve çalışma tamamlanmıştır. Nihayet çalışma sırasında edindiğimiz kanaatler ise, “Sonuç” kısmında topluca yer almaktadır
The subject of this work constitutes a case that prevents the right to legal prejudice. In this context, the study has primarily included basic information on legal prejudice. Here the concept of the right to legal prejudice has been explained, and then the legal nature of the right to legal prejudice and the conditions necessary for use have been discussed. After that, the tax has been revealed and the conditions have been examined. In the end, the effect of the real taxi on the legal prejudice has been explained and the work has been completed.
