In order to protect the public order, the action that disrupts the public order should be imposed sanction in the relationship between people and administration. The general framework of this area is determined by the administrative sanction law. The lack of a system unity of administrative sanctions in various laws and the lack of a general law on administrative sanctions would be a major shortcoming in terms of legal security and predictability. In addition, the growing field of activity of the administration day-to-day leads to the expansion of the field of administrative sanctions. Particularly, administration’s ability to impose direct sanctions without resting upon a judicial decision during the execution of the state's executive function has required to lay down the general principles prevailing in the field of administrative sanctions. Within the scope of the tendency to decriminalization of misdemeanor offenses, the general rules on administrative sanctions have been regulated by a law for the first time with the entry into force of the Misdemeanor Act No. 5326. In addition to this, the types of administrative sanctions, and the principles of legal remedies have been determined by the Misdemeanor Act No. 5326. Within the scope of these explanation, in this study, the concepts of misdemeanor and sanction as well as the feature of Misdemeanor Act’s being a general law are explained, and the issues regarding the deficiencies of Misdemeanor Act is discussed within the framework of the decisions of the Constitutional Court.
