Edinilmiş mallara katılma rejiminin 01.01.2002 tarihinden itibaren yürürlüğe girmesiyle birlikte bu konuda yargıya pek çok dava intikal etmeye başlamıştır. Bu zamana kadar edinilmiş mallara katılma rejimi ile ilgili pek çok kitap ve makale kaleme alınmıştır. Ancak hayat hadiselerinin çeşitliliği, daha önce akademik çalışma konusu olmamış son derece karmaşık ve halli güç meselelerin hâkimin önüne gelmesine yol açabilmektedir. Bu durum, özellikle ilk derece mahkemelerinin işini oldukça güçleştirmektedir. Güçlüğün bir sebebi de yeni olması sebebiyle çok iyi bilinmeyen bu mal rejiminin aynı zamanda karışık bir rejim olmasıdır. Bazı konularda henüz bir Yargıtay içtihadının olmaması veya çelişkili içtihatların bulunması da aile mahkemesi hâkiminin işini güçleştiren bir diğer önemli faktördür. Bu makalede, edinilmiş mallara katılma rejimi ile ilgili ortaya çıkan bazı meseleler üzerinde durulmuştur. Amacımız edinilmiş mallara katılma rejimini tüm yönleriyle incelemek değildir. İnceleme konusu yapılan meseleler, az karşılaşılan veya Yargıtay’ın çelişkili kararlarına konu olan meselelerdir. Özellikle anlaşmalı boşanmalarda “mal” kavramından ne anlaşılması gerektiği, dava zamanaşımı, bankadaki paraların ve faizlerinin nasıl tasfiyeye tabi tutulacağı, şirket hisseleri ve arsa payı karşılığı kat yapım sözleşmesinden kaynaklanan alacağın tasfiyesi konuları üzerinde durulmuş ve varsa Yargıtay Kararları da tartışıldıktan sonra şahsi düşüncemiz beyan edilmiştir.
