Anayasanın 80. maddesine göre, “Türkiye Büyük Millet Meclisi Üyeleri, seçildikleri bölgeyi veya kendilerini seçenleri değil, bütün milleti temsil ederler”. Daha önceki Anayasalarımızda da yer alan bu hüküm, klasik temsili rejimin yerleşmiş bir ilkesidir. Bu ilkeye göre milletvekilleri tüm milletin temsilcisidir. Türkiye Milletvekilliği konusu iki farklı gerekçe ile zaman zaman gündeme gelmiştir. Bunlardan birincisi 1995 yılında, görevleri dolayısıyla siyasi partilere giremeyen, herhangi bir seçim bölgesinde, seçmen tabanı da olmayan değerli uzman ve bürokratları milletvekili olmalarını sağlamak gerekçesiyle düşünülmüştür. İkincisi ise, Ülke genelinde uygulanan %10’luk genel barajın engel olduğu temsil adaleti ve yönetimde istikrarı bu yolla dengelemek. Anayasanın 80. maddesi, milletvekillerinin mutlaka belli bir bölgeden seçilmelerini emretmemektir. Anayasanın bu düzenlemesinden anlaşılması gereken, belli bir bölgeden seçilmiş olsalar dahi seçildikleri bölgeyi değil, bütün bir milleti temsil edecekleridir. Madde başlığının “Milletin temsili” olması da bunu kanıtlamaktadır. Dolayısıyla, bu düzenleme milletvekillerinin bir bölümünün bir bölgeden veya ülke genelinden seçilebilmelerini yasaklamamaktadır.
