Eser sözleşmesinde ifanın imkânsızlaşması uygulamada sıklıkla karşılaşılan bir durumdur. Bu çalışmada ifa imkânsızlığının taraflar açısından ne gibi sonuçlar doğuracağı ele alınmıştır. Öncelikle imkânsızlık kavramı ve türleri açıklanmıştır. Daha sonra eser sözleşmesinde ifa imkânsızlığı durumunda yüklenicinin veya iş sahibinin ne gibi haklara sahip olabileceğine temas edilmiştir. Eserin teslimden önce telef olması, malzemenin yok olması, iş sahibi ve müteahhidin kusuruyla ifanın imkânsızlaşması gibi durumlar ayrıntılı bir şekilde incelenmiştir.
The unlikelyness of the expression in the work contract is a situation that is often encountered in the practice. In this study, IFA has been discussed what the consequences of the impossibility of the parties will result. First, the concept of impossibility and the kinds of impossibility are explained. In the event of an impairment in the work contract, the contractor or the business owner may have any rights. It has been thoroughly examined cases such as the fact that the work is lost before delivery, the loss of the material, the failure of the employer and the contractor to express it is impossible.
