Özet:

Replying to religious questions (fatwa) takes an important place within the scope of Islamic religious services. Therefore, it is paid attention for those people who will perform these sensitive services possess some important quali' cations like education level. Along with the institutionalization of religious services, a speci' c educational process has been the most expected characterististic for the election and assignment of Muftis like other staffs in religious services. The procedure and expected educational level for the election and assignment of Shayk al-Islam who was the capitol (İstnabul) Mufti in Ottoman Empire has been the subject of several research therefore it is a well-known topic. Even if it is dif' cult to observe the same process for the Muftis in rural areas, it is a fact that madrasah that was the higher religion education institution in Ottoman Empire was a prerequisite for the election and assignment of those people. Although there has been different procedures on the assignment of city and district Muftis within the process after the department of Religious Affairs of Turkey underto- ok the religious services in the republic period, taking higher religion education of the- se people was accepted as the basic condition. However, + exibility was provided for this condition in some periods when the suf' cient quali' ed staff could not be found
