Divorce results in a number of legal rights and duties for the divorced parties in Islamic law. The most significant of divorce results is the duty of iddah waiting. The period that a woman should wait before getting married to someone else in case of dissolution of marriage, is examined in the title of ‘idda/iddah’ in Islamic law. Iddah, existed and applied in the almost entire legal systems and mostly societies is the former and most important religious and legal duty of a divorced woman. Performing this duty is of numerous benefits to the divorced parties, their relatives and the society. However, Iddah has not been adequately regarded at the present time. Because, it is assumed that iddah waiting is unnecessary after medically confirming the nonpregnancy of the woman and it is also seen that a second marriage occurs without iddah waiting following the dissolution of the former. In addition to that, the woman can leave her spouse’s house immediately. This article provides general knowledge of iddah matter by also comparing it with Turkish civil law in necessary conditions due to emphisize the significance of iddah.
