Bu çalış manın amacı Yeni Kamu Yönetimi Yaklaş ımı bağ lamında Türkiye’de yapılan yerel yönetim reformlarının merkez yerel ikileminde ortaya koyduğ u yeni vesayet iliş kisini 5393 sayılı Belediye Kanunu’na tabi belediyeler açısından değ erlendirmektir. Bu çalış mada Türkiye’de merkez-yerel ikileminde var olan vesayet iliş kisi ü. açıdan irdelenmiş tir: 1930 tarihli ve 1580 sayılı Belediye Kanunu, yeni uygulamaya giren 5393 sayılı Belediye Kanunu ve Yüksek Yargı’nın vermiş olduğ u kararlar… Her bir açıyı incelemek için söz konusu olgulara dair veriler içerik analizi ve arş iv araş tırması yöntemi kullanılarak değ erlendirmeye tabi tutulmuş tur. Bu değ erlendirmeler neticesinde, Türkiye’de 1580 sayılı Belediye Kanunu’nda vesayet iliş kisinin ağırlıklı takdir yetkisi üzerinden yürütüldüğü, yeni belediye kanunlarında takdir yetkisinin olabildiğince sığlaştırılarak hukuka uygunluk denetiminin ön plana çıkartıldığı iddiasının yüksek yargının da takınmış olduğu tavır nedeniyle çok da gerçekçi olmadığı sonucuna varılmış tır. Bu sonuçtan hareketle idarenin bütünlüğünün sağ lanması açısından kullanılan hukuka uygunluk ve yerindelik denetimine dair vesayet iliş kisinin nasıl olması gerektiği ele alınıp çalış ma tamamlanmıştır.
